Quayside Kingston Harbour DA appealed, Tuesday 26/10/10

After achieving a second Development Application (DA) approval for Quayside Kingston Harbour, ACT Planning and Land Authority's (ACTPLA) Notice of Decision has again been appealed to the ACT Administrative Appeals Tribunal (ACAT) by our neighbouring developer, Consolidated Builders Limited (Mainore Pty Ltd) for Pearl Apartments.

Development Application program

CIC Australia submitted a new Development Application (DA) for Quayside to ACTPLA for assessment, on 30 June. This DA included a redesign of parts of the development affected by the ACT Administrative Appeals Tribunal ruling earlier this year.

The public notification period for this DA has closed. ACTPLA is continuing to assess the application following the standard process timetable, and we expect formal approval in October.

New Development Application submitted

CIC Australia decided not to appeal the ACT Administrative Appeals Tribunal (ACAT) ruling of 16 April, in which the Development Application (DA) for Quayside Kingston Harbour was refused. We have redesigned parts of the development affected by the ACAT ruling and subsequently submitted a new DA to ACTPLA for assessment on 30 June.

The new DA will be assessed by ACTPLA following the standard process timetable. As such, the DA will be subject to the same public notification, representation and appeal process, as all other DA’s.

ACTPLA are fully aware that the design changes adequately reflect the outcome of the ACAT ruling. CIC is confident therefore that the new DA will be approved in due course.

ACT Civil and Administrative Tribunal (ACAT) Result

The ACT Civil and Administrative Tribunal (ACAT) refused the Development Application for Quayside Kingston Harbour on Friday 16 April 2010. There have been some mixed messages in the media immediately following this announcement, and we have prepared the following to clarify information about the outcome and to let you know the next steps.

Firstly, it is important to understand that the ACAT appeal was against the ACT Planning and Land Authority (ACTPLA) by our neighbouring developer Consolidated Builders Limited (Mainore Pty Ltd) for Pearl Apartments, not CIC Australia or Quayside Kingston Harbour. The appeal related to ACTPLA‘s approval processes.

The ACAT ruling found that even though ACTPLA and the Land Development Agency had judged Quayside as 100 per cent compliant, the development should not proceed in its current form. The ruling raises a major issue relating to the number of, and inconsistency between, ACT planning regulations. At Kingston Foreshore for example, there are about five separate sets of regulations, which overlap and are open to different interpretations. Ironically the ruling will now prompt the respective Government agencies to rectify the inconsistencies.

Clearly CIC Australia is disappointed with this ruling, as Quayside received full ACT Government approval and endorsement in August last year. Indeed the Quayside design was described by ACTPLA as one that respected the character of the area, and the development was confirmed as one that would not adversely affect the amenity of nearby properties.

We have invested much time, money and energy into the vision of Quayside and are frustrated by the ruling, but we see this setback as another step in the process of bringing the project to fruition.

We don’t believe at this stage there will be much impact on purchasers at Quayside and are working hard to prepare our response to the ACAT decision. It goes without saying that we will explore all avenues to keep the development progressing.

The ACAT hearing was completed on Tuesday 16/3/10. We now await an outcome from the Tribunal, and will post any advice on this website when we hear.

CIC Australia received Development Application approval for Quayside Kingston Harbour from the ACT Government in 2009. This approval is currently being appealed in the ACT Civil and Administrative Tribunal in response to legal action between Consolidated Builders Limited (Mainore) for Pearl Apartments, and ACT Planning and Land Authority. CIC Australia has been asked to join as a party in the proceedings with ACTPLA to protect its interests.

While we believe it is inappropriate to comment on the proceedings while the hearings are still in train, we will provide advice on this website following the conclusion of proceedings.
